AEC statement: Unauthorised pamphlets in Wentworth

On Monday 21 April, the AEC distributed an initial media statement about this matter.

The AEC first became aware of the distribution of unauthorised pamphlets late last week after a number of Wentworth residents in receipt of the unauthorised pamphlets made complaints.  The AEC has been investigating, and continues to investigate, this matter to ascertain further facts. This has resulted in the identification of an individual behind the unauthorised material – the AEC will not be providing the name of this person at this time.

To date, our investigation has only identified evidence that this individual has acted alone, and the individual concerned has confirmed this is the case. There is no evidence to indicate that they are or have ever been affiliated with any political party or candidate currently contesting the election for the Division of Wentworth.     

A written undertaking has been sought and received by the AEC from the individual responsible for the unauthorised pamphlets that they will not distribute any further copies of the material or any other unauthorised electoral matter during the 2025 federal election period. The AEC accepts this undertaking and at this stage does not consider an injunction is required.

The AEC is considering its litigation options including in relation to its powers to seek civil penalties in relation to contraventions of s 321D of the Electoral Act.  A final decision on this will be made after the election. Unless there are further developments, the AEC will not be making further comments about the matter during the final days of the election period.

Voters are reminded to stop and consider the source of all messages relating to the 2025 federal election.
