How these terms and conditions of use apply

The Privacy Notice explains how we manage the personal information we collect.

These terms and conditions of use relate to how we use the AEC EmployMe. The AEC EmployMe is a digital service administered by the Australian Electoral Commission (AEC). When you use the AEC EmployMe, we make it available to you on the terms and conditions of use current as at that time. These terms and conditions of use may change over time. Those current at a given time are those then published on this page. If you continue to use the AEC EmployMe after the terms have been changed, it will mean you have agreed to the changes. These terms and conditions of use are governed by and follow the laws for the time being in force in the Australian Capital Territory, Australia.

Our terms

You are responsible for the security and use of your AEC EmployMe profile and the device on which it is stored. You must comply with all security requirements and instructions provided by the AEC about your use of the AEC EmployMe.

You must:

  • provide information that is true, accurate, current and complete to create your employment profile;
  • always close your AEC EmployMe browser sessions and lock your device when not in use; and
  • notify the AEC via our Online Privacy Form or in writing if you believe the security of your log in details or employment profile has been compromised.

You must not:

  • disclose your login details and password to any other person;
  • use the AEC EmployMe for any unlawful or improper purpose;
  • use the AEC EmployMe to use or create a false identity, impersonate any person or otherwise misrepresent your identity;
  • access, monitor or use any data, systems or networks without authority (for example, by hacking) or attempt to probe, scan or test the vulnerability of any data, system or network;
  • attempt to gain access to the account of any other user; and
  • engage in any activities which expose the AEC to liability.

Where the AEC suspects or becomes aware of a breach of these terms and conditions of use, the AEC may revoke your access and deny you further access to the AEC EmployMe. To the extent permitted by law, the AEC:

  • provides the AEC EmployMe ‘as is’ and without charge;
  • gives no express or implied warranties or makes any representation (and to the full extent permitted by law excludes all statutory warranties) for each of those elements (including its availability, security, performance or fitness for a particular purpose); and
  • will not be liable for any loss or damage (including special, indirect or consequential) arising from or in connection with any element of the AEC EmployMe or its availability, use or performance either directly or through a third-party provider.

To the extent that the AEC’s liability for the AEC EmployMe (or any part of it) cannot be excluded, it is limited to the resupply of the relevant goods or services, or the cost of such resupply, at the AEC’s option, or otherwise limited to the minimum amount permitted by law. The AEC makes no guarantees that the AEC EmployMe, and your access to it, will be continuously available, uninterrupted, and fault or error free. Your access to the AEC EmployMe is also contingent on telecommunication services and other factors beyond the AEC’s control. These terms and conditions of use constitute the entire agreement between you and the AEC as administrator of the AEC EmployMe. They supersede all prior communications, representations, agreements or understanding about these terms.
